EVANSVILLE, Ind. – Evansville Police are seeking multiple child seduction charges against an Evansville man who allegedly sexually abused a teenager he knew.

Timothy Smith, 33, was arrested Friday night on four preliminary charges of child seduction and one preliminary charge of attempted child seduction.

According to a probable cause affidavit, the alleged victim told investigators that Smith performed oral sex on them twice and also forced them to masturbate him twice. This reportedly happened during two separate encounters in February.

He was also accused of approaching the victim in March and asking them to have sex, but backing off when the victim got upset and said they did not want to. The affidavit does not say the exact date the victim reported the abuse to their parent, who called police, but Smith was arrested the same week as the March encounter the victim reported.

Under Indiana law, an adult can be charged with child seduction if they have sexual contact with a 16- or 17-year-old when they are in a position of authority or trust over that teenager.

For example, the law applies if the adult is the minor’s guardian or a child care worker, or if they have a professional relationship with the victim as a military recruiter or a mental health professional.

Smith does not face any formal charges in Vanderburgh County yet as of Monday afternoon. His initial hearing is scheduled for 1 p.m. Wednesday in Vanderburgh Circuit Court.

Smith was ordered not to have any contact with the alleged victim. He is being held in Vanderburgh County Jail with no bond available.
