Can You Sue a School for Sexual Misconduct by a Principal?

Attorney contributor Jeff Gibson is a school abuse attorney who represents sex assault victims and their families in civil lawsuits. Jeff has recently shared his thoughts regarding a school’s liability for sexual assault by teachers and other school employees.

“The education system has a growing problem with the sexual assault of students at the hands of teachers and other employees. Sadly, our attorneys have seen reports of school sex assault across all 50 states. School officials should make it their priority to do all they can to prevent their students from becoming victims of sexual predators on the school campus.”

“If a school employee, such as a principal, is charged with sexual misconduct with a student, it is crucial to investigate if the school was negligent. Many cases of student sex assault could have been prevented by the school. If the officials ignored past reports of inappropriate behavior by the employee, lacked security measures like cameras, or failed to conduct background checks, they could be considered negligent. In many negligence cases, victims and their parents may have sufficient grounds for a civil lawsuit against the school. If you fear your child has been a victim of sexual abuse by a teacher, it is highly recommended to learn more about your legal options from an experienced school abuse attorney.”
