Five Winter Springs High School students have been charged with gang-raping a 16-year-old girl in November near their school while another accused student will go free.
Charges were dropped on Tuesday against 18-year-old Torreano Batton, the only adult of the six students arrested on Nov. 19.
Deoante Stewart, 17, Marquis Pierre, 17, Tobert Aleaxander, 16, Josea Sims, 17, and Tywuan Johnson, 17, meanwhile all face charges due to DNA evidence and a video recorded on the victim’s cellphone.
“Mr. Batton, as we have maintained from the first day, is not on that video,” Batton’s Public Defender Jeff Dowdy told media on Tuesday. “He was not part of the group.”
The sexual assault reportedly took place between 3 to 5 p.m. Nov. 13 in the wooded area just north of the McDonald’s at the corner of State Road 434 and Tuscawilla Road, near the Seminole County Trail and Winter Springs High School.
Stewart and Pierre will be charged as adults for their roles in the crime.
