Sex offender arrested on child pornography charges

FARMINGTON — A convicted sex offender has been accused of distribution and possession of child pornography following an investigation by local and state agencies.

Anthony Mihaley, 56, of Kirtland, has been accused of distribution of visual medium of sexual exploitation of children and possession of visual medium of sexual exploitation (child under 13), according to court records.

He had no legal representation as of this afternoon, according to court records.

Mihaley is accused of downloading a computer file that is considered to be child pornography and having another computer download the file using the BitTorrent network, according to the arrest warrant affidavit.

The case was investigated by New Mexico Attorney General’s Office and the San Juan County Sheriff’s Office.

A special agent for the state AG’s Office forwarded a report of an alleged child sexual exploitation case that took place at a Kirtland home earlier this year to the sheriff’s office.

As part of the investigation, the special agent determined the IP address of the electronic device that allegedly downloaded and transferred the child pornography file was tied to a Kirtland address.

An investigation by the sheriff’s office turned up several police reports tied to the residence.

One of the reports showed Mihaley had been arrested in June last year for failing to register as a sex offender and concealing identity, according to court records. He entered a guilty plea to the two charges as part of a plea agreement during an April 24 hearing in district court.

The affidavit for the child pornography charges states Mihaley was convicted of “rape of a child” in Pacific County, Wash., in 2000. It also states he had two prior convictions for failing to register as a sex offender in different states.

A search warrant was executed on Mihaley’s residence on April 16, and several electronics devices, including a laptop computer, an external hard drive and cell phones, were taken as evidence, according to court documents.

A forensic search of a hard drive inside Mihaley’s laptop computer indicated the child pornography file was allegedly downloaded from the suspect’s computer to another computer.

haley’s preliminary hearing is scheduled for 8 a.m. Thursday in Aztec Magistrate Court. He was being held today at the San Juan County Adult Detention Center on a no-bond hold.
